Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes prohibited activities related to the use of the Services.

Important: This policy is aligned with the laws of the Republic of Serbia and the regulations of the European Union, including GDPR (General Data Protection Regulation) and the E-Commerce Directive.

Prohibited Activities

Child Exploitation

Offering goods or services, or posting or uploading Materials that exploit or abuse children is strictly prohibited, including images, videos, or depictions of child sexual abuse.

Harassment, Abuse, Defamation, and Threats

Harassing, threatening, defaming, or abusing other users or third parties is prohibited.

Hate Content

Promoting hatred or violence against individuals based on race, ethnicity, skin color, national origin, religion, age, gender, sexual orientation, disability, or any other discriminatory basis is prohibited.

Illegal Activities

Posting, uploading, or selling goods or services that violate applicable laws in Serbia, the EU, or any jurisdiction in which you operate is prohibited.

Intellectual Property

Offering goods or services, or posting or uploading Materials that infringe copyrights, trademarks, or other intellectual property rights of third parties is prohibited.

Malicious and Deceptive Activities

Transmitting malicious software, hosting phishing pages, or engaging in activities that disrupt the Services or the infrastructure of Shopwidget or third parties is prohibited.

Protected Personal Data

In accordance with GDPR and Serbian law, posting or uploading personal data of other individuals without their explicit consent is prohibited. This includes personally identifiable information (name, email, address), financial data (card numbers), and confidential information (e.g. passwords).

Restricted Products

Offering products classified as firearms, bladed weapons, and their parts, as defined in the original AUP policy, is prohibited.

Self-Harm

Posting content that promotes or encourages self-harm is prohibited.

Spam and Unsolicited Content

Sending unsolicited commercial messages or spam content is prohibited.

Terrorist Organizations

Supporting, financing, or promoting terrorist organizations is strictly prohibited.

GDPR and Data Protection

• Data Collection: All personal data must be processed in accordance with GDPR and the Serbian Law on Personal Data Protection.
• Consent: Explicit user consent or a lawful legal basis is required before collecting, processing, or sharing personal data.
• User Rights: Users have the right to access, rectify, erase, and transfer their data, as well as the right to withdraw consent at any time.

Enforcement Measures

Shopwidget may, at any time and without prior notice, remove any Materials and suspend or terminate your Account or access to the Services if it determines that you have engaged in activities that violate this policy, including activities occurring outside the direct use of the Services.

Shopwidget has the right, but not the obligation, to monitor or review Materials and your use of the Services at any time to verify compliance with this policy, the Shopwidget Terms of Use, or any other agreement between you and Shopwidget (collectively: "Terms").

Shopwidget’s determination of whether a violation has occurred is final and binding. Any enforcement action, including taking no action, is carried out at Shopwidget’s sole discretion.

Policy Changes

Shopwidget may modify this policy at any time by publishing an updated version on the official website. Continued use of the Services or access to the Account after such publication constitutes acceptance of the current version.

In the event of a conflict between the Terms of Use and this policy, this policy shall prevail only to the extent necessary to resolve the conflict. Capitalized terms not defined herein have the meanings assigned to them in the Terms.

AUP Definitions

The following definitions apply to the Shopwidget Acceptable Use Policy ("AUP"). Shopwidget reserves the right to modify these definitions at any time.

"Materials" means any photograph, image, video, graphic, written content, audio recording, code, information, data, or other content that is uploaded, collected, generated, stored, displayed, distributed, transmitted, or otherwise used in connection with your Account.
